If The Raiders Win Their Suit Against JaMarcus Russell, How Do We, "The Fans", Get Our Money Back?


It was just reported on CSN Bay Area's Sports Ticker that the Raiders are looking for, in excess of, 9 million dollars from JaMarcus Russell.

My guess is that this suit will focus on his work ethic and insubordination (not reading his play book).

This is the saga that I expected and I cannot say that it is undeserved.

My question is will there be a trickle down effect? To the fans? If the Raiders win?

And an even more intriguing question...What should the fans do with the money in this pipe dream?

IMO there is zero chance of that happening

I suppose they will say something along the lines of it going back into player development or whatever, but I seriously doubt it would effect the fan’s wallet or experience one bit.

people who bought tickets still got to go to the games i don’t see any basis for any claim by the fans. I personally would prefer the money be re-invested in the team anyway, i didn’t buy anything on the condition that JaMarcus has to try hard if any ‘refund’ is given then by that logic we should have been getting free Raider stuff for the last 7 years!.

Of course the fans won't get anything

directly. But in the bigger scheme of things, the money will get reinvested into signing good players and maybe upgrading (or go into the new one) stadium. So we would benefit, but not in any direct way.

I wonder what the wider implications of this are.

Will future free agents see this as a negative in thier decisions to sign with the Raiders? I’ve often wondered if coaches refused to sign with Oakland due to the Shannahan/Kiffin sagas. These moves say a lot about Al Davis’ character. It seems as if he cares far more about his money than he does about his reputation. Even if successful in his bid to recover his money, is he the winner in the long term? Does he even care? I am a die hard Broncos fan, but more than that, I am a fan of Football. As much as I root against the Raiders I’ve always had nothing but respect for the organization. Moves like this damage that respect.

I think it could work maybe in both ways

and it may send a message to other new draftees to be prepared to work for it. And if the Raiders win, it could open the door for other teams to do the same…

I agree that if they win it won't matter.

The treatment of and recovery from the Russell era may define this team for the forseeable future. All that being said I hope this comes to some positive. I would like to see the Raiders do better in the next few years. Maybe we can throw down the Chargers and dominate the division like in the good days.

yes,he was a bumm and dosent deserve the money.if we have a job and dont come to the site prepaired to work,late or some how impared that it would effect our job performance we would get fired and most of us wouldent get a fat pay check to send us off.but after all the positive things that have happened this year,do we realy need this kind of thing dragging out through the seasson or possably years.every time we hear about Russell we will hear about how Al screwed him out of money just like we hear about Shanahans bitch ass all the time.

I am pretty certain Shanahan has given that case up.

Once you sue the NFL, any individual is going to be small time. They just aren’t going to have the horsepower to hang with Al in court. This case will be interesting to say the least.

Al is trying to recoup money instead of avoid paying it, so he will actually have to win this case, instead of forcing a stand still like the case against his coaches. I don’t see JaMarcus making sound legal decisions and he is going to be swooped down upon by legal vultures offering him all kinds of crazy ass advice.

This case could set a presidence in the world of sports contracts.

It seems to be based on the fact that part of what he was paid was advance on future salary that he will now not be with the team for rather than any insubordination from what I have read, the raiders contend that the contract was changed at some point or something so it will be interesting if the actual shithouse effort will have any bearing on the result.

Another stupid Al Davis idea

What this shows to the world is the owner has no clue about the contracts that he handed out to rookies. Every year, Raiders paid excessively for the first round player that it drafted, causing negotiation problems for the other teams with their first round picks after Oakland. By releasing Russell early, money that had to be paid for future guaranteed periods should legally still be honoured because Russell was effectively fired. Raiders, as a team, effectively shot themselves in both feet, if the guarantees are without any minimum performance standards required in prior years. If they hadn’t thought about that before releasing Russell, it shows further the ineptness of the front office. Unfortunately the fans are the ones to suffer and are footing the expensive bill for an inferior product on the field.

1) The remaining balance of his contract was incentive laded. It was based on how much % he started and such.

2) First round negotiation problems are going to be inherently intense.

3) You don’t know what the contract details were in completeness, so you can’t say for a fact that he doesn’t know about rookie contracts. He’s been a GM and or coach in this league for a long time. I’m sure and his right hand lady know more than you do. From what I read, it’s hinged on that the 32 million was advanced for all the years on his contract. If he’s no longer there, then the money should be given back.

While I don't think Al will get his money back I believe Spirals once posted a comment explaining how contracts for rookies are laid out & how the team can go after money.

I’m probably one of the few who are happy they gave him $3 million to get lost. Also I want to be the first to start a ban on all Jamarcus Russell related posts. He isn’t with the team and he is a bad memory I want to forget.

Yes - I was sure they'd go after something of this kind.

I took some courses in labor and employment law recently and was quite thrilled to see a case in action.

The Jamarcus case interests me greatly, b/c I am a teacher and see a lot of similar cases in my classes. A gifted student whose initial instructors failed to do their job because they were too enthralled with his talent. The result is self-complacency, a habit hard to break up by later instructors. Such students are a nightmare.

I am sure you have thought about this, but humble them. Then challenge them with something that they will throw themselves into. To different degrees everyone is competitive and if you can awaken that competitive drive, the person will seek out ways to better themselves.

It’s about arising passion. This is certainly easier said then done, especially depending on the subject you are teaching. I am a big believer that you can’t tell someone to change. You can only help lead a person to the conclusion that they need to change.

I didn’t mean humiliation as much as I meant being humbled by a great challenge. This didn’t do much good for Russell though.

You bring up a good point. This is why Russell was able to sit back and justify his struggles as a result of the players around him. There was no awaking his passion. I wonder if he is still blaming others in his head? This is one of the reasons I enjoyed Michael Jordan’s HoF speech. It was such a great glimpse at what at what motivated an elite level talent. Granted it was spite, but it sure fueled him. You’d hope the pursuit of greatness would be enough. Maybe we should start viewing heart as a talent.

However, I came to the conclusion that I don’t think Russell had the necessary talents to be an elite lever QB and this is if he had the drive or not.

It will get drawn out because attorneys get paid by the hour, hence, no incentive to have a quick resolution. This will strictly be how do you define “guaranteed” and how a judge will view “guaranteed”. JR showed up and went through the initial planned activities and got cut. unless special language was included with a different definition of guaranteed, AD will lose out.

Davis won't get his money back? History tells us he will.

Been a Raiders fan since the 60’s, I have watched Al’s every move.

First of all, want to say to the bone head people, saying Davis is wasting money on legal fees, don’t know squat about the Raiders organization. Al’s left hand man, or should I say women, is Dark Queen attorney at law Amy Trask. They say Trask is the most powerful women in the NFL and the brains of the Raiders front office for the last 20 some odd years. Not to mention a slew of other in house attorneys Davis has on the payroll.

Davis has long been considered one of the most controversial owners in the NFL and has been involved in multiple lawsuits involving Los Angeles, Oakland, Irwindale and the NFL. Davis’s track record in the court room is impeccable. In other words, the Raiders organization is a law firm in it’s self. Also, Davis is a shrewd businessman and he knows the law.

I’m not sure what the Raiders are shooting for, but I can tell you this, Russell will not see one red cent of the 3 million dollars owed to him this season. you can ask Shanahan and Kiffin about owed money coming to them. The only reason the Raiders had Russell in mini camp, is to see if he would show up, if he didn’t the Raiders would have had bigger cause to hold back money. So this pretty much sounds like the 3 million owed to him, not about 9.5 million.

If the Raiders discovered a way to add a loophole to the contract during renegotiation which will allow them to recover money, good for them. The way Russell goes through money, judging from his jewelry, jaunts to Las Vegas and generally lavish spending habits, you wonder if he’ll have $.9.55 million to return to the Raiders if he loses the grievance.

And what you don’t think Russell’s crack legal team can compete with Al’s? You couldn’t be more right about the 3 mil this year. Recouping the other money is going to be an interesting case.

Also, you are completely right about the Raiders keeping Russell around this year. The only reason was to solidify their case against him. People wondered what the hell Al was doing by keeping him on the roster, but it was obvious once they got Campbell that the only reason Russell was there was so he could provide them just cause to fire him.

Russell’s fate was sealed once he did whatever the hell he did that caused Al to say it was ok to bench him last year. I suspect as this case progresses we will hear some of these details.

People also knock Al for being clueless, and he has certainly made some questionable football decisions, but the guy is still shrewd. I think his biggest problem is rampant meglomania.

I would also add that Al is recouping some of his money by making JR spend some of his “unearned” money on this case that will drag out.
JR obviously can’t manage his weight whatsoever, so one can only imagine his money managing skills are similar.
He’s probably not gonna be picked up by another team who will be paying him much.
I would say the next big story we hear about Jawalrus would be how he files for bankrupcy. Either that or something similar to Pizza the Hut in Spaceballs and commited suicide by eating himself to death!!!!

Jamarcus Russell is a perfect example of why they should eliminate guaranteed money. Just because you were good in High School or College does not mean you will be good in the Big Leagues. I'd call it dumb, but that'd wouldn't be derogatory enough.

He is asking for his release. He is unhappy there because of his playing time situation and they are not going to promise him more here as they are committed to giving the youngsters their snaps.

If, and this is unlikely, he wanted to come here for cheap without being guaranteed a starting spot then I’d be all for it.

"They had paid him a $19.9M salary advance prior to the supersede and paid out a $3.44M signing bonus following the supersede."

Whether that $19.9 million is legally considered a “salary advance” or an “option bonus” is the heart of this dispute, because the $9.5 million comes from that pot.

This could be the most interesting case regarding player contracts

It’s always the fans that take the hit. The owners bitch about how much the players are making. The players just take what they can get, but it’s the fans paying for it whether by tickets, merchandise, or simply because of the ad revenue which wouldn’t be worth anything if people aren’t watching tv.

Walker showed up and did what he had to

and the Raiders chose to bench him because they were upset he didn’t tell them about his surgery. He also tried to give back money and retired, but Davis talked him out of it. Not sure the Raiders would have a case there.

Al might want those millions for TO or others, I mean Al isn’t really stingy, he did give Deanglo Hall and Javon Walker ridiculous contracts they didn’t earn, he even turned down Walkers attempt to give the money back, which was shocking in this day and age for an athlete to do. Russell must have done some really grimy stuff to our organization for Al not to pay him, like Shanny being “Shanny”, lane Kiffin being a weasel, or Jamarcus doing nothing.

He’s gone. It would have been something to do when he was still w/ us to send a message I suppose. But now, who really cares?

Really this whole story about the grievance isn’t really news, at least not front page news. But eh well.

I do not understand why he is only doing this now, it’s disgusting I really hope he never plays again, I couldn’t stand to see him have success somewhere else.

i just don't understand how someone could throw it all away like he has.

I’m sure if he came back to mini-camp at 260 he would still be getting paid 9milli this season, it really does not make any sense i can understand just sucking but the changes in coaches etc do not excuse lack of effort – absolutely MIND BOGGLING.
